Applies to all who intend to use Share Your Business’ services. 
This version of the Terms & Conditions is effective as of February 14 2020. 

 

1. INTRODUCTION

These Terms & Conditions apply between Share Your Business Sweden AB, organization number 559120-3475, referred to as “Share Your Business”, “We”, and “Us”, and you as a user of its services, referred to as “User” and “The User”. Physical persons with a registered account with any of Share Your Business’ services, as well as those who visit their services without a registered account, are considered users of the service.

Share Your Business provides a tool for mediating household services, referred to as “Service” and/or “The Service”, and is thus not providing these services itself. The Service is a platform that mediates contact between users who seek the services mediated on the platform, referred to as “Job Provider”, and users offering those services, referred to as “Job Taker”. The Service is available through mobile application for Android and iOS devices, referred to as “App” and/or “The App”, and on the web, referred to as “Website” and/or “The Website”.

For access to The Service users are required to accept these Terms & Conditions in full. By accepting these conditions you commit yourself to following them in their entirety. Users of The Service are solely responsible for staying updated on the contents of these Terms & Conditions. We therefore urge everyone who intends to our Service to read them carefully, and recommend that you save a copy for future use. 


2. ABOUT THE SERVICE

2.1 Definition of The Service
Share Your Business provides a tool for individuals to search, request, and offer help with various household services. In The Service a user, called “Job Provider”, can create ads requesting a service, which then other users, called “Job Taker”, can offer to help with by placing a bid for their services on the ad. The Job Poster can choose to accept a bid and therein enter a contract with the Job Taker for execution of the contracted service. 

Share Your Business is solely a tool for the mediation of household services, and thus does not offer these services itself. We do not undertake performing the services mediated in The Service, and thus cannot be held accountable for their quality or execution. Share Your Business is not a part in the agreement entered by Job Poster and Job Taker, and is therefore not bound by its obligations and/or rights.

2.2. Access to The Service 
For access to The Service the user needs access to a smartphone with the Share Your Business app installed. The user needs to register in the App with a phone number, and enter an agreement for the use of Share Your Business’ services by accepting these Terms & Conditions. 

To register an account with Share Your Business the user needs to be a physical person, 16 years old, and have the right to work in the country which they intend to perform their services in. Users that wish to leave bids and offer their services in The Service need to register their bank account information and upload a photo of either their passport or ID in the App, in order to receive payments.

2.3 Availability of The Service 
Share Your Business provides The Service in its existing condition, and intends to keep it accessible 24 hours each day of the year. However, Share Your Business cannot guarantee access without disturbances, and The Service may from time to time be inaccessible in part or fully, due to reasons such as, but not limited to, maintenance, improvements, security updates, or inadequate internet connection. We can therefore not be held accountable for possible loss of information and/or compensation for services due to such causes. 

3. PROCESSING OF PERSONAL DATA

To provide our Services in its entirety, we gather certain information about our users. For more information on how we gather and process our users’ personal data, please see our Privacy Policy.  

 

4. USING THE SERVICE

4.1 The User’s Responsibility 
You as a user of The Service are responsible for making sure that all information you enter when registering in the App and/or on the Website is correct. Users are limited to 1 account each, which may not be utilized by persons other than themselves. It falls within the responsibility of the user to take appropriate action to ensure that their account is not used by unauthorized persons. 

By accepting these Terms & Conditions you agree to use The Service in a way that complies with what is established in these Terms & Conditions and applicable laws. Share Your Business reserves the right to shut off users that violate these terms or applicable legislation in their usage of our Service.

4.2 Ad Creation Rules
It is not allowed to create and/or post job ads in The Service that: 

- Request removal of heavy waste; 
- Offer illegal types of work, such as, but not limited to, human trafficking, prostitution, and criminal activities; 
- Offer work where one comes in contact with hazardous or harmful materials, such as, but not limited to, asbestos or eternit
- Contain illegal substances; 
- Contain animals in any way; 

The agreement that the Job Taker enters with the Job Poster, upon their acceptance of the Job Poster’s bid, is binding for both parties with the terms that have been agreed upon. It is not permitted for any party to contact the other for the purpose of executing and receiving payment for the agreed service outside of the Share Your Business platform. It is thereto not permitted for any party to change the terms or compensation for the agreed upon service after the bid has been accepted by the Job Poster.

4.3 User Generated Content 
User generated content can be found in The Service in the form of text and pictures from the creation of job ads, profiles, and submission of bids. By accepting these Terms & Conditions you as a user accept full responsibility for possessing all necessary rights for the information and content that you create and/or upload to The Service. By accepting these Terms & Conditions you also agree to not upload any copyrighted material that you do not own yourself or have explicit permission of the owner(s) to use.

By accepting these Terms & Conditions you give Share Your Business, for the purpose of marketing our Service, complete rights to all material you have created and/or uploaded in The Service, as well as the right to transfer these rights to our partners. By accepting these terms you waive all rights to compensation from Share Your Business and/or our partners, for using the material you generate in The Service.

4.4 Ownership when Purchasing Materials
For jobs where the Job Poster and Job Taker have agreed upon purchase of materials for the job (so called “Buy for me” ads), the Job Taker has ownership of the materials until they have arrived at the job site. When the Job Taker arrives at the site ownership of the materials automatically passes from the Job Taker to the Job Poster.

4.5 Taxes & Declaration
The purchase and/or sale of the services mediated through The Service may come with certain taxation. Users of The Service are solely responsible for ensuring that their declaration and taxes are filed correctly and in accordance with regulation. A specific person’s final taxes are highly individual and determined by many different factors. For more information about taxes and what applies to your specific situation, please see Skatteverket’s website (www.skatteverket.se). 

 

5.  IMMATERIAL RIGHTS

If nothing else is specified, Share Your Business owns every right to all material in The Service. This includes, but is not limited to, its design, layout, software, and process. This material is protected by immaterial rights, brand rights, or patents, and is thus protected property and forbidden to reproduce and/or share, wholly or in part, without our expressed permission. 
For posting links to Share Your Business’ Service a request to do so should be sent to us, to ensure that information about our Service is not misleading. Links to our Service through so-called Pop-up windows are not permitted, and should instead be opened in the same window or a new one. 

 

6. PAYMENTS IN THE SERVICE

For payments through The Service to be possible we use a third party service provider called Stripe (www.stripe.com), that provides us with their payment solution. When registering in The Service and accepting our Terms & Conditions, you also accept Stripe’s own Terms & Conditions and are thus bound to comply with them. Users of The Service are solely responsible for ensuring that all personal and bank information entered when registering, and delivered to Stripe, is correct and truthful. 

When the Job Poster accepts a bid from a Job Taker, they are charged on their registered card 15% the agreed amount of compensation for the service. This sum is debited as a form of assurance for the Job Taker, and is non-refundable. For a job to be fulfilled the Jon Poster is required to give their authorize a hold on their registered bank account for the remaining sum for the job compensation, at the latest the day before the agreed upon time for the job. The Job Poster is asked to authorize the hold starting a week before the agreed upon date for the job, and will receive a reminder through email and/or text to their registered phone number 3 and 2 days before the agreed upon date of the job. A last reminder will be sent the day before the job, whereafter the job will be canceled if Share Your Business does not receive the Job Poster’s authorization at the latest 12 hours before the agreed upon time for the job to be performed.

After the job has been marked as completed in the App by the Job Poster and Job Taker, the Job Poster i debited the amount of the hold, and it is released to the Job Takers registered bank account. By agreeing to these Terms & Conditions you accept that Share Your Business charges a fee of 15% of the total work compensation for every completed service mediated through our platform. This fee is deducted from the agreed amount of compensation for the work, and the rest is paid out to the Job Taker for their services, 5-10 working days after the job is completed. 


7. SHARE YOUR BUSINESS’ RESPONSIBILITY

The Service is provided in its current condition, and is normally available 24 hours a day, 365 days a year. Share Your Business cannot guarantee that access will be flawless and/or without interruption, and thus cannot be held accountable for potential losses due to this. More information about availability of The Service can be found under section 2.3.

Share Your Business är merely a tool for mediating household services, and consequently not a part in the agreement entered by Job Poster and Job Taker upon the acceptance of a bid. The terms that have been agreed upon for execution of the service are binding for both parties. Job Taker commits themselves to executing the service in the way that has been agreed upon, and the Job Poster commits themselves to physically be present at the agreed time and place for the service. By accepting these Terms & Conditions you accept that Share Your Business does not undertake to perform the agreed upon service.

Share Your Business can therefore not be held accountable and is not liable to pay damages for any potential losses and/or damages caused due to use of The Service and/or the execution of the agreed service. Share Your Business does not undertake resolving conflict or matters regarding potential damages and/or losses, and users are thus asked to reach out to the other party directly. 

 

8. SPECIAL CAMPAIGNS AND DISCOUNTS

Share Your Business offers from time to time discounts on the services mediated through our Service, as well as other offers in cooperation with our partners. To take part in these discounts the user needs to meet the requirements and terms of the specific offer. For discounts offered in cooperation with our partners users may be required to meet additional terms and requirements from our partners. Share Your Business reserves the right to at any time, without warning, change and/or end campaigns, discounts, and offers, as well as their terms. 

9. CHANGES 

9.1 Changes of The Service
Share Your Business reserves the right to at any time, without warning, remove, change, or in another way adjust features in The Service. Share Your Business is not responsible for potential loss of information and/or compensation due to these changes, and thus cannot be held claimed for compensation.

9.2 Changes to the Terms & Conditions
Share Your Business reserves the right to from time to time change the contents in these Terms & Conditions. We will inform users of The Service about its changes, through email or by publication of this to the Website and/or the App. Changes to these terms go into effect the date they are published for new users, and 30 days from being notified about the changes for previously registered users.
